What do we use your data?
Some of the data is collected in order to ensure error-free provision of the website. Other data may be used to analyse your user behaviour.

Insofar as a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user’s terminal device (e.g. for device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

Order processing
We have concluded a contract on order processing (AVV) for the use of the above-mentioned service. Period of saving

Unless a more specific period of saving has been specified within this privacy policy, your personal data will be retained by us until the purpose for processing the data no longer applies. If you claim a legitimate request for deletion or cancel consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted after these reasons cease to apply.

General information on the legal data processing basis on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6 para. 1 lit. a DSGVO or Art. 9 para. 2 lit. a DSGVO if special categories of data are processed according to Art. 9 para. 1 DSGVO. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49 (1) a DSGVO. If you have consented to the storage of cookies or to the access to information in your terminal device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of § 25 para. 1 TTDSG. This consent can be cancelled at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual steps, we process your data on the basis of Art. 6 para. 1 lit. b DSGVO. Furthermore, if your data is required for the fulfilment of a legal requirement, we process it on the basis of Art. 6 para. 1 lit. c DSGVO. Furthermore, the data processing may be on the basis of our legitimate interest according to Art. 6 para. 1 lit. f DSGVO. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this data protection declaration.

Information on data transfer to the USA and other non-EU countries

Furthermore, we use tools from companies based in the USA or other non-EU countries that are not protected by data protection laws. If these tools are active, your personal data may be transferred to these non-EU countries and processed there. We would like to inform you that no level of data protection can be guaranteed in these countries that is comparable to that in the EU. For example, US companies are required to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Cancelling your consent to data processing

Many data processing operations are only possible with your specific consent. You can cancel permission you have already given at any time. The legality of the data processing carried out until the cancellation remains unaffected by the cancellation.

Right to oppose data collection in specific cases and direct marketing (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION DECLARATION. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21(1) DSGVO). IF YOUR PERSONAL DATA ARE PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 PARA. 2 DSGVO).

Right of complaint to the responsible supervisory institution

In the case of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory institution, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. The data protection supervisory institution responsible for our registered office is the

Bayerisches Landesamt für Datenschutzaufsicht (BayLDA)
Promenade 18
91522 Ansbach
https://www.lda.bayern.de

The right of complaint shall be without prejudice to any other administrative or judicial remedy.

Right to data transferability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if it is technically possible.

Information, Cancellation and Correction

Within the context of the current legal requirements, you have the right at any time to free information about your saved personal data, its origin and recipient and the purpose of the data processing and, if necessary, a right to correction or deletion of this data. You can contact us at any time for this purpose and for further questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restrictions of the processing of your personal data. To do this, you can contact us at any time. The right to restriction of processing exists in the following cases:

  • If you disagree with the correctness of your personal data saved by us, we usually need time to check this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening illegitimately, you can request the restriction of data processing instead of cancellation.
  • If we no longer need your personal data, but you need it to exercise, defend or enforce legal claims, you have the right to request restriction of the processing of your personal data instead of cancellation.
  • If you have submitted an objection in according with Art. 21 (1) DSGVO, a consideration must be made between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to demand the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data may – apart from being stored – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL and TLS coding

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising emails

The use of contact data published within the scope of the imprint requirement to send advertising and information material that has not been expressly requested is hereby prohibited. The owners of the pages expressly reserve the right to take legal action in the event of the non-requested sending of advertising information, e.g. via spam emails.

4. Data collection on this website

Server log data

The provider of the pages automatically collects and records information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The registration of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be collected.

Use of technically necessary cookies (session cookies)

Our website uses technically necessary cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user’s computer system. When our website is accessed, a cookie may be stored on your operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again.

We use cookies to make our website more user-friendly. Some elements of our website require that the calling browser can be identified even after a page change. The cookies are automatically deleted after you close your browser. The legal basis for the processing of your personal data in the context of the use of technically necessary cookies is Art. 6 para. 1 lit. f EU-DSGVO.

The use of technically necessary cookies serves to enable you to use our website. Certain functions of our website cannot be offered without the use of cookies. The user data collected through technically necessary cookies are not used to create user profiles.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after we have completed processing your enquiry). Mandatory legal provisions – in particular retention periods – remain unaffected. Enquiry by e-mail, telephone or fax If you contact us by e-mail, telephone or fax, your enquiry including all personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested; consent can be revoked at any time.

The data you send us via contact requests will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Request by email, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of processing your request.

The data you send us via contact requests will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory statutory provisions (in particular statutory retention periods) remain unaffected.

Additional data protection information for our candidates (m/f/d)

If you apply for a position in our company, your application is completely voluntary and you can also withdraw your application at any time. Within our company, those offices and departments receive personal data that they need to carry out the application process.  We process all data and documents relevant to the application process, in particular the following types of personal data:

  • Name, date of birth, curriculum vitae, nationality/work permit
  • Contact details, especially address, telephone number, email
  • Certificates, qualifications, e.g. driving licence
  • If applicable, data on health suitability and any restrictions
  • Severe disability, if applicable

We process the personal data received from you and, if applicable, personal data permissibly received from other bodies or other third parties, insofar as this is necessary for the application process and we are permitted to process this data in accordance with the statutory provisions. In particular, we process personal data that we have permissibly obtained, received or acquired from publicly accessible sources, e.g. information about you in social networks, trade and association registers, civil registers, press, internet and other media.

The processing of this data is based on the fulfilment of a contract or pre-contractual measures, Art. 6 para. 1 lit. b) EU-DSGVO in conjunction with § 26 BDSG. Your personal data is processed for the purpose of processing your application in response to a specific job advertisement or as a speculative application, and in this context in particular for the following purposes:

  • To check and assess your suitability for the vacant position
  • To draw up the employment contract
  • To assert legal claims and defend you in legal disputes

Your data will only be processed if and to the extent that there are no overriding interests on your part that speak against such processing.

Your personal data may also be processed with your consent on the basis of Art. 6 para. 1 lit. a) EU-DSGVO in conjunction with. § Section 26 BDSG for certain purposes, e.g. for obtaining references from previous applicants. As a rule, you can revoke this consent at any time for the future. Processing that took place before the revocation is not affected by this and remains lawful. You will be informed separately about the purposes and consequences of revoking or refusing consent in the relevant text of the consent. If your application documents contain photos, we consider this to be implied consent to process your photo. Pursuant to Art. 7 para. 3 sentence 1 DSGVO, you are entitled to revoke this consent at any time.

We also process your personal data to fulfil various legal obligations to which we are subject. These are, for example, labour, social, commercial and tax law regulations. In this case, the legal basis for processing is the respective legal regulations in conjunction with Art. 6 para. 1 lit. Art. 6 para. 1 lit. c DSGVO and in conjunction with. § 26 BDSG. Insofar as special categories of personal data, in particular health data, are processed in accordance with Art. 9 (1) DSGVO, this serves exclusively to fulfil the obligations incumbent upon us in accordance with § 164 SGB IX within the scope of the application process.

Within our company, those persons, internal offices or organisational units will receive your data to the extent that these persons need them to fulfil our contractual and legal obligations or within the scope of processing and implementing our legitimate interest, e.g. executives and specialist managers who are looking for a new employee or are involved in the decision on filling a position, accounting, etc.

Your data will only be passed on to external bodies if

  • for purposes where we are obliged to provide information, report or pass on data in order to comply with legal requirements, e.g. tax authorities, or are entitled to do so, or where the passing on of data is in the public interest.
  • insofar as external service companies process data on our behalf as order processors or function transferees, e.g. external IT service providers, web providers.
  • on the basis of our legitimate interest or the legitimate interest of the third party for within the scope of the above-mentioned purposes, e.g. to lawyers.
  • if you have given us consent to transfer your data to third parties.

We will not pass on your data to third parties unless we inform you of this separately. Insofar as we commission service providers within the scope of order processing, your data is subject there to the security standards specified by us in order to adequately protect your data. In other cases, the recipients may only use the data for the purposes for which it was transmitted to them.

Your personal data will be deleted as soon as it is no longer required for the application process, e.g. if your application is rejected or a negative decision is issued. This does not apply if legal regulations prevent the deletion or if the continued storage is necessary for evidentiary purposes. For example, personal data may be retained for evidentiary purposes for the time during which there is a possibility of claims being asserted against our company, e.g. claims under the General Equal Treatment Act.

If your application is followed by the conclusion of a contract, your data will continue to be stored and used for the purposes of the usual organisational and administrative process and the implementation of the employment relationship in compliance with the relevant legal provisions. You will be informed of the details in connection with the respective process.

Currently, no data transfer to third countries takes place and this is not planned.

5. Social media

Facebook

To enhance our internet presence, we offer a Facebook page. This is a service provided by Facebook Ireland Ltd, 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland.

We would like to point out that you use this Facebook page and its functions on your own responsibility. This applies in particular to the use of the interactive functions (e.g. commenting, sharing, rating).

When you visit our Facebook page, Facebook collects, among other things, your IP address and other information that is stored on your PC in the form of cookies. This information is used to provide us, as operators of the Facebook pages, with statistical information about the use of the Facebook page. Facebook provides more detailed information on this at the following link: https://de-de.facebook.com/help/pages/insights .

The data collected about you in this context is processed by Facebook Ltd. and may be transferred to countries outside the European Union. Facebook describes in general terms what information it receives and how it is used in its data usage guidelines. There you will also find information on how to contact Facebook and on the settings for advertisements. The data usage guidelines are available at the following link: https://de-de.facebook.com/about/privacy.

Facebook’s full data policies can be found here: https://de-de.facebook.com/help/568137493302217

In what way Facebook uses data from visits to Facebook pages for its own purposes, to what extent activities on the Facebook page are assigned to individual users, how long Facebook stores this data and whether data from a visit to the Facebook page is passed on to third parties is not conclusively and clearly stated by Facebook and is not known to us. When you access a Facebook page, the IP address assigned to your terminal device is transmitted to Facebook. According to Facebook, this IP address is anonymised (for “German” IP addresses) and deleted after 90 days. Facebook also stores information about the end devices of its users (e.g. as part of the “login notification” function); this may enable Facebook to assign IP addresses to individual users.

If you are currently logged in to Facebook as a user, a cookie with your Facebook ID is stored on your end device. This enables Facebook to track that you have visited this page and how you have used it. This also applies to all other Facebook pages. Facebook buttons embedded in websites enable Facebook to record your visits to these website pages and assign them to your Facebook profile. This data can be used to offer content or advertising tailored to you.

If you wish to avoid this, you should log out of Facebook or deactivate the “stay logged in” function, delete the cookies present on your device and close and restart your browser. This will delete Facebook information that can be used to directly identify you. This allows you to use our Facebook page without revealing your Facebook identifier. When you access interactive features of the page (Like, Comment, Share, Message, etc.), a Facebook login screen will appear. Once you have logged in, you will again be recognisable to Facebook as a specific user.

Information on how to manage or delete information about you can be found on the following Facebook support pages: https://de-de.facebook.com/about/privacy#.

As the provider of the information service, we also collect and process the following data from your use of our service: publicly viewable data from the user profile of the person concerned. This includes, for example, the user name, the profile picture, contents of comments written on our posts.

Further information on Facebook and other social networks and how you can protect your data can also be found at www.youngdata.de.

LinkedIn

Our website uses so-called social plugins (“plugins”) of the online service LinkedIn, which is operated by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA (“LinkedIn”).

In order to increase the protection of your data when visiting our website, these buttons are not fully integrated into the page as plugins, but only using an HTML link. This type of integration ensures that when you call up a page of our website that contains such buttons, no connection is yet established with the servers of LinkedIn. When you click on the button, a new browser window opens and calls up the LinkedIn page on which you can interact with the plugins there (possibly after entering your login data).

For the purpose and scope of the data collection and the further processing and use of the data by LinkedIn, as well as your rights in this regard and setting options for protecting your privacy, please refer to LinkedIn’s data protection information: https://www.linkedin.com/legal/privacy-policy

XING

To expand our internet presence, we are represented on XING. XING is an internet-based social network that allows users to connect with existing business contacts and make new business contacts. Individual users can create a personal profile of themselves on XING. Companies can, for example, create company profiles and publish job offers on XING.

The operating company of XING is XING AG, Dammtorstraße 30, 20354 Hamburg, Germany. If you click on the XING button integrated on our website, XING assigns this information to your personal XING user account and stores this personal data. XING always receives information via the button that you have visited our website if you are logged in to XING at the same time as calling up our website; this only takes place when you click on the XING button.

If you do not want XING to associate your visit to our website with your user account on XING, please log out of your user account before activating the button. You can find Xing’s privacy policy at:

6. Newsletter

Newsletter details

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data is collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties. The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the email address and their use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation. The data you provide us with for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter or after the purpose has ceased to exist. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest according to Art. 6 Para. 1 lit. f DSGVO. Data that has been stored by us for other purposes remains unaffected by this. After you have unsubscribed from the newsletter distribution list, your email address will be stored by us or the newsletter service provider in a blacklist if necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO). The saving in the blacklist is not limited in time. You can object to the saving of your data if your interests outweigh our legitimate interest.

7. Plugins and Tools

YouTube with extended data protection

This website embeds videos from the website YouTube. The operator of the pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, regardless of whether you watch a video, YouTube establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to YouTube’s servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account. Furthermore, after starting a video, YouTube may save various cookies on your end device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience and prevent fraud attempts.

If necessary, further data processing processes may be triggered after the start of a YouTube video, over which we have no control. YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the saving of cookies or access to information in the user’s terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time. For more information about data protection at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de.
